Drone Operator Insurance Requirements – Sea Otter Classic

The Sea Otter Classic (Sea Otter) requires, without limiting the duty to indemnify, that the Drone Operator (Operator) shall maintain in effect throughout the term of the Agreement a policy or policies of insurance issued by companies which hold a current policy holder’s alphabetic and financial size category rating of not less than A- VII, according to the current Best’s Key Rating Guide or a company of equal financial stability that is approved by Sea Otter. The policy shall have the following minimum limits of liability:

Indemnity and Hold Harmless: Operator shall indemnify and hold harmless Sea Otter Classic, Inc. and the Sea Otter Classic Foundation, Inc. its directors, officers, employees, agents, stockholders, affiliates, subcontractors and customers from and against all allegations, claims, actions, suits, demands, damages, liabilities, obligations, losses, settlements, judgments, costs and expenses (including without limitation attorneys’ fees and costs) which arise out of, relate to or result from any act or omission of Operator.

Commercial general liability insurance, including but not limited to premises and operations, including coverage for Bodily Injury and Property Damage, Personal Injury, Contractual Liability, Broad Form Property Damage, Independent Contractors, Products and Completed Operations, with a combined single limit for Bodily Injury and Property Damage of not less than $1,000,000 per occurrence and $2,000,000 in the aggregate.

Certificate of Liability Insurance: Operator must provide proof of general liability coverage with the minimum limits of liability as noted above naming both the Sea Otter Classic, Inc. and the Sea Otter Classic Foundation, Inc. as additional insured. Other additional insureds may be required by Sea Otter. Certificates of liability insurance must be provided to Sea Otter before the Operator will be allowed to setup for the Event at the Facility.

YOU MAY BE REQUIRED TO PROVIDE PROOF OF THE FOLLOWING INSURANCE COVERAGE. YOU WILL BE CONTACTED BY A SEA OTTER CLASSIC STAFF MEMBER IF YOUR PARTICIPATION IN THE SEA OTTER CLASSIC REQUIRES THE FOLLOWING COVERAGES.

Business automobile liability insurance, covering all motor vehicles, including leased, non-owned, and hired vehicles, used in providing services under this Agreement, with a combined single limit for Bodily Injury and Property Damage of not less than $1,000,000 per occurrence.

Workers’ Compensation Insurance, if Operator employs others in the performance of this Agreement, in accordance with California Labor Code section 3700 and with Employer’s Liability limits not less than $1,000,000 each person, $1,000,000 each accident and $1,000,000 each disease.

Professional liability insurance, if required for the professional services being provided, in the amount of not less than $1,000,000 per occurrence and $2,000,000 in the aggregate, to cover liability for malpractice or errors or omissions made in the course of rendering professional services. If professional liability insurance is written on a “claims-made” basis rather than an occurrence basis, the Operator shall, upon the expiration or earlier termination of this Agreement, obtain extended reporting coverage (“tail coverage”) with the same liability limits. Any such tail coverage shall continue for at least three years following the expiration or earlier termination of this Agreement.

Drone Operator Insurance Requirements – County of Monterey

 

REQUIREMENTS

  1. WORKERS COMPENSATION California Statutory limits
  2. Comprehensive General Liability, bodily injury and property damage, combined single amount $1,000,000.00

Comprehensive General policies shall provide an endorsement naming:

The County of Monterey, its officers, agents and employees; the Sports Car Racing Association of the Monterey Peninsula (SCRAMP), its officers, agents and employees; as named additional insureds.
Policy shall also be endorsed to provide that such insurance is primary insurance and that no separate insurance policy or self-insurance of the additional named insureds shall be called on to contribute to any loss incurred in connection with the Drone operator’s performance.

The above described coverage shall be maintained through the term of the service agreement and the Operator shall file with SCRAMP a Certificate of Insurance (COI) evidencing that any insurance coverage required herein have been obtained and are currently in effect.
